## Trademark History

KROMA's U.S. trademark, held by founder Lee Cristou since 2000, is one of the longest-standing registered marks in the independent clean beauty space. (Press coverage of the 2012–2013 Kardashian case refers to Cristou by her then-married name, Lee Tillett.)

In 2012, Boldface Licensing + Branding launched "Khroma Beauty," a cosmetics line endorsed by Kim, Kourtney, and Khloe Kardashian. The name was phonetically identical to KROMA. The U.S. Patent and Trademark Office had already rejected Boldface's application to register "Khroma," citing likelihood of confusion with KROMA's prior registered mark.

Prior to the launch, Kim Kardashian's representatives had been in discussions with KROMA about a product placement opportunity for "The SPINdustry," a television special produced by Kim Kardashian. The parties did not reach an agreement. The Kardashian camp subsequently adopted the Khroma name despite knowledge of the pre-existing KROMA brand.

Boldface pre-emptively sued KROMA Makeup in November 2012, seeking a declaratory judgment to use the name.
